Emergency medicine cases can involve complex questions about a patient’s presentation, diagnosis, treatment, and the decisions made during a limited window of care.
When you send me a case, I review the medical record from the perspective of an experienced Emergency Medicine physician. My job is to help you understand the medical issues at the center of the case and determine what the evidence actually supports.
I approach every review the same way. I examine the available medical evidence thoroughly, evaluate the care that was provided, and give you a clear assessment of my findings.

For Plaintiff Counsel
If you represent someone who may have been harmed by improper emergency medical care, I can review the available medical records to evaluate the care provided and determine whether the evidence supports a finding of medical negligence.
If I identify negligence within my areas of expertise, I can provide a written opinion, prepare an affidavit of merit, and continue to work with you through deposition and trial when needed.
For Defense Counsel
An allegation of medical negligence does not necessarily mean the care provided was negligent.
I work with defense counsel to independently evaluate the medical record, the patient’s presentation, the care provided, and the clinical decisions made by the treating providers.
My responsibility is to tell you what I believe the medical evidence supports, even when that isn’t the answer you hoped to hear.
Emergency Medicine Case Review
A medical record can document what occurred. Understanding the clinical significance of that record requires experience.
I personally review the records relevant to the care in question, which may include:
Patient presentation and reported symptoms
Emergency department evaluation
Differential diagnosis
Diagnostic testing
Interpretation of clinical findings
Treatment decisions
Patient monitoring and reassessment
Discharge decisions and instructions
Referral, consultation, or transfer
Applicable standards of emergency medical care
I evaluate the patient’s presentation, the care provided, and the clinical decisions documented in the record to determine whether there is evidence of medical negligence.
Experience Matters
More Than Three Decades Practicing Emergency Medicine
Dr. Mallory completed his Emergency Medicine residency at Delaware Valley Medical Center in 1992 and has been board certified by the American Osteopathic Board of Emergency Medicine since 1993.
Over the course of his career, he has served as an attending Emergency Medicine physician at hospitals throughout Florida. His clinical work has required him to evaluate patients, make time-sensitive decisions, and provide the types of emergency care that may later become the subject of medical litigation.
For the past 13 years, Dr. Mallory has also performed medical expert witness and medical-legal review work. He has reviewed approximately 200 medical cases and has provided expert services for plaintiff and defense attorneys as well as individuals seeking an independent review of their medical care.

What Happens When You Send Me a Case?
1. Send Me the Medical Records
Provide the medical records relevant to the case. Depending on the matter, these may include the emergency department chart, history and physical, discharge summary, physician progress notes, and other relevant records.
2. I Review the Medical Evidence
I personally review the records and evaluate the care that was provided. My goal is to determine whether the medical evidence supports a finding of negligence.
3. I Give You My Findings
After my review, I’ll discuss my findings with you by phone and provide a written report.
If I don’t find evidence of medical negligence, I’ll tell you. If I do identify negligence within my areas of expertise, I’ll explain what I found and why I believe the care was improper.
4. I Remain Available as the Case Proceeds
When appropriate, I can prepare an affidavit of merit detailing the identified negligence and continue working with you as the matter proceeds through deposition and trial.
